The US Supreme Court has ruled that The National Labor Relations Act gives workers the right to request UNION REPRESENTATION during investigatory interviews by supervisors, security personnel, and any other managerial staff.
Defined Investigatory interview occurs if management questions you to obtain information and you have a reasonable belief that your answers could be used as a basis for discipline or other action against you.
***YOU MUST ASK FOR YOUR UNION REPRESENTATIVE*** either at the beginning or during the interview- Management does not have to tell you that you have this right!
IF you are called to a meeting with management- state that you “Under Weingarten Rights and I respectfully request that my union rep. and until my union rep. arrives I choose not to answer questions”
Management has three options at this point: It can stop questions until the rep arrives, it can call off the interview, or management can ask you to wave these rights(an option that a union member should always refuse to do). If management does not do any of these and continues questions– REPORT to the UNION immediately as this is an unfair labor practice.
